What is Legal Videography?

So what is legal videography? Broadly defined, it's the practice and profession of utilizing audio and video gear to capture, prepare, and present testimony and evidence in legal proceedings. It may sound complex and technical, but let me simplify it for you.

Imagine all the things that you can do with your smartphone. You can take photos, shoot videos, and edit them. You can trim in and out points, add titles, apply filters, and even combine multiple photos and videos. These are the same capabilities required in legal videography, but executed on a professional level.

The Role of a Legal Videographer

Legal videography encompasses tasks similar to those you handle on your phone. You capture, edit, and prepare media for specific purposes. However, as a legal videographer, the stakes are higher. You are required to use professional skills, equipment and experiences to ensure the highest quality results.

Lawyers are experts in the law, but not necessarily in technology. Often, they have questions like, "Is it possible to edit this video?" or "Can we add a voiceover to this?". These are common queries because lawyers need to use various media forms to help present their cases, but they are not necessarily adept at producing them. This is where you, as a legal videographer, step in to provide solutions.

Let's break down this broad definition into its component parts to make it simpler:

1. The Practice and Profession

  • Professionalism: This is about how you dress, treat others, solve problems, and the level of service you provide. As a legal videographer, you'll be working alongside other professionals like lawyers, paralegals, and judges. It's crucial to treat them with respect and professionalism.

  • Education: Continuous learning is vital. You need to stay updated through various sources like online articles, videos, and manuals of the equipment you're using. This continuous development is key to mastering your craft.

2. Mastering the Technology

  • Tools of the Trade: Audio and video gear are your tools. Mastery over these is essential to deliver high-quality work. Whether it’s audio production, video production, or post-production, you need to be proficient.

  • Capture, Prepare, and Present: These three stages map to the phases of video production: pre-production, production, and post-production.

Phases of Legal Videography

1. Capture

Encompasses pre-production and production tasks like setting up the location, equipment, and ultimately recording the video.

2. Prepare

After capturing the video, you need to prepare it for clients, encoding it into a usable format, ensuring that they can easily use and understand it.

3. Present

This involves presenting the video in a courtroom setting or another legal context, which can sometimes require live editing.

Differentiating Testimony and Evidence

1. Testimony

This is the on-record statement from witnesses and is critical to the legal proceedings.

This can be broken down into actual admissible evidence and demonstrative evidence, which helps illustrate particular points to the court.

Legal videographers get involved at different stages of litigation, primarily during the discovery phase. However, the video you capture can be presented and re-used throughout the entire litigation process, from pretrial motions to the actual trial and even in appeals.
